Free access to labour market

The right to free access to the labour market means that third-country nationals can work, be employed or self-employed in Slovenia without consent to the single permit, EU Blue Card or seasonal work permit (unless an international treaty binding on Slovenia provides otherwise).

Which are the third countries?

  • They are not European Union Member States or countries of the European Economic Area (Norway, Iceland, Lichtenstein).
  • Switzerland is also not a third country.

Foreign nationals with free access to the labour market

Under the Employment, Self-employment and Work of Foreigners Act third-country nationals have the right to free access to the Slovenian labour market if:

  • you are residing in Slovenia on the basis of a temporary residence permit for family reunification with a Slovenian citizen;
     
  • you are residing in Slovenia on the basis of a permanent residence permit;
     
  • you are residing in Slovenia on the basis of a temporary residence permit issued to a foreigner of Slovenian origin;
     
  • you are residing in Slovenia on the basis of a temporary residence permit issued to a victim of trafficking in human beings;
     
  • you are residing in Slovenia on the basis of a temporary residence permit issued to a victim of illegal employment;
     
  • you are granted the right to international protection in Slovenia and your family members are residing in the country on the basis of a residence permit for family reunification;
     
  • you are granted the temporary protection status (demonstrated by an appropriate identity card);
     
  • your identity has been established beyond doubt and you have been granted the status of an applicant for international protection in Slovenia, namely nine months after filing an application for international protection, provided that no decision of the competent authority has been served thereon in that period and the delay cannot be attributed to you (you can demonstrate the fulfilment of the aforementioned conditions by means of a certificate from the ministry responsible for internal affairs).

Moreover, the above mentioned groups of foreign nationals have the right to free access to the Slovenian labour market during their residence in the country on the basis of a certificate demonstrating that the application for extension of a residence permit or status was submitted in due time.
