General Terms and Conditions with Privacy Statement
1. Introductory provisions
The General Terms and Conditions define the terms of use of the websites of the Employment Service of Slovenia (hereinafter: ESS) and their components, publicly available services of the ESS's information system (web applications, portals, programs; hereinafter: eServices) and the ESS's policy on the protection of personal data.
2. About the ESS website
The ESS reserves the right to modify the content of this website at any time and in any way, regardless of the reason and without prior notice.
The ESS will endeavour to ensure the most accurate and up to date information on its website, but accepts no liability for the information’s accuracy, and users make use of the posted content at their own responsibility.
Neither the ESS nor any other legal or natural person that was involved in the creation and design of the ESS’s website may be held liable for any damage arising from access to content, the use of or inability to use information on the ESS’s website, or for any errors or deficiencies in its content.
3. Protection of intellectual property rights
Pursuant to the Act regulating copyright and associated rights, the ESS holds the copyright on the content of intellectual property rights in the broadest sense (information, documents, photographs, graphic elements, illustrations and other presentational material) published on the ESS website and on its constituent parts, and these are the property of the ESS or other parties that have transferred the right to their use to the ESS.
Information and documents may be downloaded from the ESS website for personal use, wherein the user may not alter the designations of copyrights and other intellectual or property rights. Information and documents intended for perusal and reading may not be downloaded and printed for commercial purposes.
Information and documents published on the ESS’s website may not be copied, reproduced, altered, sent by ordinary or electronic mail or distributed in some other way without the express written permission of the owner of the website.
The website, eServices or parts thereof may not be used for commercial, illegal or any other purposes than those set out in these conditions of use.
It is prohibited to use automated browsing, searching or other robots that automatically obtain data from the ESS’s website, from web applications, portals or programmes of the ESS or in some other way automatically browse the website, applications, portals or programmes or communicate with them. Meta searching on the website, applications, portals and programmes of the ESS is prohibited, except for searching through the use of general web browsers.
Equally, the use of any element from the ESS’s website in any way other than exclusively for personal, non-commercial purposes is strictly prohibited.
The use of the website and eServices of the ESS contrary to the stated rules is prohibited.
In the event of a suspicion of abuse of the stated rules and/or in the event that a user’s actions threaten the operation of the eServices, a limit will be placed on such user’s access to the website and/or the ESS’s eServices.
Users that use the ESS’s website in a manner that is contrary to the specified rules shall be fully liable materially and in tort.
In accordance with the provisions of the Act regulating copyright and associated rights, official texts in the legislative, administrative and judicial fields are not protected by copyright.
4. Information on the website administration
The purposes for which personal data are processed, and legal basis for their processing and storage
A. Visit to the website
At every visit to the ESS's website, web server log files (for example, an IP number – a number that identifies an individual computer or other device on the internet) are automatically stored on the web server.
The World Wide Web works by recording certain data about website visits, such as IP number, browser version, time of visit, etc., on the web server where the site is hosted.
The ESS does not separately process the data collected in such a way and does not link them with other data.
The purpose of these procedures is to ensure network and information security, i.e. to enable detection and prevention of unauthorised access which may jeopardise the accessibility, integrity and confidentiality of stored or transferred personal data and the security of related services that are accessible through these networks and systems.
Such processing is necessary for the performance of the public tasks of the controller.
The data are stored for 30 days from the visit to the website.
B. Registration for eServices
When registering for eServices (e.g. on the portal PoiščiDelo.si or the employers’ portal and Portal for jobseekers), upon registration with user name and password the ESS processes the data on your name, surname, user name (email address) and password (encoded in the database).
In registration of a user with a qualified certificate issued in Slovenia, in addition to the above data the ESS processes data on the user’s tax ID number.
For the purposes of submitting electronic applications and electronic signing of documents, which the ESS uses in the services of the PoiščiDelo.si portal for electronic cooperation with the ESS, data on the user’s email address and mobile telephone number are also processed.
The ESS processes other personal data on the PoiščiDelo.si portal only with the consent of the data subject to the processing of personal data that relate to them.
The ESS will gather, store and otherwise process the personal data of users exclusively for the needs of providing electronic services (eServices) offered by the ESS website, to improve the use of the website and for the purpose/s for which website users will provide such data (e.g. upon consent granted, a jobseeker’s data are transferred from the PoiščiDelo.si portal to the EURES portal for the purpose of searching and connecting with employers on the basis of vacancies within the EURES network).
Upon registration for eServices, users give their personal consent regarding which personal data, and for what purposes, the ESS may process. In such case personal data are processed on the basis of the individual’s valid consent (Article 6(1a) GDPR).
If the ESS processes users’ personal data on the basis of carrying out legally required obligations, it undertakes to process the personal data for the fulfilment of its competences and in accordance with the regulations governing personal data protection.
The legal basis in the case of processing the personal data of a jobseeker’s profile on the PoiščiDelo.si portal and their transfer to the EURES portal is provided by the EURES Regulation (EU) 2016/589 and Commission Implementing Decision (EU) 2017/1257 (on standards and formats).
The user account is deleted on the basis of the client’s request, or automatically after 18 months from the last login to the ESS’s PoisciDelo.si portal, whereby in order to ensure the rights of users the electronic communication and documents generated as part of the eServices for jobseekers and intended for cooperation with the ESS will be stored for one year following deletion of the account.
Based on a submitted request for deletion of a user account, the user is notified in writing at the email address given in the user account of the successful deletion of the user account and with it all data and documents.
Deletion of the user account does not mean deregistration from the ESS records and has no bearing on the processing of data processed by the ESS in accordance with the Labour Market Regulation Act (ZUTD).
Registered users of the portal www. PoiščiDelo.si and the Portal for jobseekers must sign all applications and certain documents for which electronic signature is required in the eServices system. By signing, the document is submitted to the ESS.
The ESS processes personal data for the purpose of implementing measures pursuant to the Labour Market Regulation Act (Article 15 of the ZUTD): services for the labour market (lifelong career orientation and forwarding employment opportunities), the active employment policy, unemployment insurance and ensuring the rights under compulsory and voluntary unemployment insurance.
The eServices system enables registered portal users to submit applications electronically (e.g. Registration in the record of unemployed persons – Article 133 ZUTD, Registration in the record of jobseekers – Article 133 ZUTD, Application for cash benefit (with attachments) – Article 58 ZUTD, Employment plan – Article 113 ZUTD) and other documents in accordance with the ZUTD.
The Decree on Administrative Operations (Article 101 UUP) defines the electronic applications which registered users can submit on this portal with an electronic signature, which is not equivalent to a hand-written signature.
The ESS processes the personal data of registered users who register voluntarily on the eServices portal of the ESS for the purpose of submitting an electronic application for the stated services based on consent.
When a registered user submits an electronic application for any of the legally provided tasks carried out by the ESS pursuant to the ZUTD and the Central Population Register Act (ZCRP, Official Gazette of the Republic of Slovenia, no. 72/06 – official consolidated text, 3/22 – ZDeb and 32/24 as amended), Article 123 ZUTD becomes the legal basis for the processing of personal data, in that it defines which personal data the ESS requires for maintaining specific records and determining of the personal identity number (EMŠO).
The ESS processes information on the tax ID number on the PoiščiDelo.si portal for the purpose of determining the individual’s identity, which may be carried out via SMS text message or by telephone call. Stating the tax ID number in the user account means that the person is identified in such a way that their identity is determined either due to registration with a digital certificate or due to determination of identity at the ESS and identification carried out via the ZPnet-Oseba-Spletni register.
By registering in the ESS records using the eServices the person also expresses their consent to the ESS operating electronically and to receiving at their registered email address electronic invitations and notifications and responding to them.
Registered users of the PoiščiDelo.si portal sign documents with a qualified digital certificate or server signature via the ESS information system, and registered users of the Portal for jobseekers sign documents electronically with a qualified digital certificate. For this purpose they receive an email with a link to the electronic document that is valid for 7 days. After opening the link the user receives a 6-character unique code (OTP) on their mobile phone that is used to access the document, which is then signed electronically. The document is given a digital time stamp that guarantees the authenticity of the signatory.
A document signed with an ESS server signature with a required two-factor authentication has the following data in the applicant’s signature: name and surname of the signatory, mobile phone number and email address with which two-factor authentication was carried out for completing the server signature via the ESS information system, date of signature and end of validity of the ESS server certificate.
A document signed with a qualified digital certificate (QDC) has the following data in the applicant’s signature: name and surname of the signatory, issuer of the digital certificate, serial number of the digital certificate, date of signature and end of validity of the digital certificate.
In order to sign an application via the portal, irrespective of the method of document signing selected, two-factor authentication of the user is performed. Two-factor authentication is a two-step IT procedure for verifying the authenticity of the registered user.
All documents on the portal which require electronic signature before submission to the ESS information system are validated with two-factor authentication, and upon signature are given a SIGENCA time stamp, or with a server qualified digital certificate of the ESS issued by SIGENCA, the qualified certifier of digital certificates. The unique identification of time of submission, irrespective of local settings of the server or user’s computer, prevents the falsification of the document submission time.
In order to submit an electronic application where required in the eServices system, the document also needs an electronic signature. Registered users of the portal can sign documents using a qualified digital certificate (QDC) issued in Slovenia or another EU Member State, or a server signature with the required two-factor authentication, which is carried out using the email address and telephone number (where the user receives the one-time password as a SMS) from the user account on the portal, which then effects the submission of the application via the ESS information system.
Registration of the user with a qualified digital certificate, electronic signature with two-factor authentication and time stamp on the document legally guarantee the authenticity of the signatory and time of submission.
Both the email address and mobile telephone number are required in the user account for signing and submitting a document. The user receives an email with a link to access the document for signing, and on their mobile phone they receive the one-time password as a SMS for accessing the application in which they will sign the document and thereby submit it to the ESS.
On the registration and submission portals ePrijava BO, ePrijava IZ, eVloga DN or eZN, when the user clicks on the button Pošljite v podpis (Send for signature), that application can no longer be edited on the portal, and the user receives an email with a link to the document for signing.
After clicking on the field Kliknite za elektronski podpis (Click for electronic signature) an application opens for signing documents. In order to access the application for signing the document, the user must enter the one-time password received by SMS. The document for signing opens and can be signed. In the case of signature with a digital certificate, the user must also install the signature component at the time of the first signature by following the instructions in the application. The document will be submitted to the ESS only after successful electronic signature.
The portal user may save documents on the portal or send them for signing and then sign them. The saved application can be edited. All documents are shown on the portal in the column List of documents.
Signed documents are stored in the ESS’s electronic documentation system.
Registrirani uporabnik se lahko identificira na način, da pristojna uradna oseba Zavoda ugotovi istovetnost uporabnika z osebno identifikacijo, identifikacijo na daljavo, ali se uporabnik identificira s kvalificiranim digitalnim potrdilom. Uporabnik se lahko v svojem uporabniškem računu kadarkoli identificira tudi na način, da naknadno vnese kvalificirano digitalno potrdilo.
Ugotavljanje istovetnosti oziroma identifikacija je postopek preverjanja istovetnosti lastnika uporabniškega računa na portalu, ki ga Zavod opravi v telefonskem razgovoru s preverjanjem podatkov, ki so znani le tej osebi oziroma, če se ne odzove na telefonsko identifikacijo, osebno z vpogledom v osebni dokument osebe. Za ta namen Zavod obdeluje telefonsko številko registriranega uporabnika.
Identifikacija uporabnika na daljavo se lahko opravi s telefonskim ali video klicem. Zavod z uporabnikom opravi intervju z namenom ugotovitve istovetnosti. Uporabnika se identificira z davčno številko in dodatnim enoličnim identifikacijskim znakom, s katerim Zavod razpolaga na podlagi 123. člena in 123. a člena ZUTD in za katerega ve le uporabnik, ki je vložil vlogo.
Identifikacija uporabnika na portalu je končni postopek s katerim se uporabniški račun na portalu poveže z osebo, ki je bila identificirana in se vodi v evidencah Zavoda.
S tem uporabnik pridobi polno funkcionalnost portala, ter dostopa do vseh 5 rubrik, ki so na voljo za elektronsko sodelovanje z Zavodom. Komunikacijo in obveščanje preko storitve Moj svetovalec po dogovoru omogoči šele svetovalec v zaposlitvenem načrtu.
Zavod obdeluje podatke o telefonski številki za namen identifikacije uporabnika na podlagi soglasja za oddajo vloge za storitev, ki jo Zavod nudi na podlagi ZUTD, in sicer za namen varstva ter preprečevanja zlorabe posameznikovih pravic.
If the user’s identity cannot be established, an invitation is sent to the user’s email requesting that they come to the ESS on a specified date in order to establish their identity based on personal identification.
If the user fails to respond to the invitation, an additional invitation is sent to their email requesting once again that they come to the ESS on a specified date in order to establish their identity based on personal identification.
If the user fails to respond to the second invitation, their application is rejected as incomplete by official decision.
An identified user registered in the ESS records may agree remotely with the ESS via the eServices regarding the content of the employment plan in accordance with the Act regulating the labour market and the Rules.
Following coordination of the content, the identified user is enabled in their user account to electronically sign the agreed employment plan.
The identified user can take up to 3 working days to sign the proposed employment plan (Article 113 ZUTD).
By signing the employment plan the identified user confirms that they are familiar with and agree to the content of the employment plan.
Following electronic signature of the employment plan by the ESS, the ESS sends the user the signed employment plan to their email via the ESS electronic documentation system.
Users of the eServices can submit an application requesting certificates from ESS official records by entering the required unique identifier.
Based on verification of the user’s identity the ESS issues the requested certificate from the ESS official records and sends it to the user by ordinary mail to their permanent or temporary address held in the Central Population Register.
The ESS will not issue a requested certificate in the event of doubt as to the requesting party’s identity or suspicion of abuse of personal data, failure to identify the requesting party or it not being possible to deliver the certificate to the permanent or temporary address held in the Central Population Register.
C. Receiving responses to e-mails from the contact form
To respond to user e-mails from the online contact form, to which the Employment Service Contact Center responds, the user's name and surname, email address, message subject, message content, sending time, and message receipt time are recorded.
The data is stored for 1 year, counted from the receipt of the e-mail from the Employment Service's online contact form, until the expiration of the retention period or until revoked on the server of an external data processor with whom we have a contract for personal data processing, which provides us with infrastructure solutions for service provision.
Users can request revocation of consent, deletion, or modification of data by sending a message to the email address: kontaktni.center@ess.gov.si.
Personal data (name and surname, email address, message subject, message content, sending time, and message receipt time) are processed based on the individual's valid consent (point (a) of Article 6(1) of the GDPR).
The Employment Service processes this data solely for the purpose of responding to user e-mails from the online contact form, to which the Employment Service Contact Center responds.
D. Receiving responses to e-mails from the EURES contact form
To respond to user e-mails from the online contact form, to which the Employment Service Contact Center responds, the user's name and surname, email address, message subject, message content, sending time, and message receipt time are recorded.
As the data controller, the Employment Service needs your data for the purpose of forwarding your question to the relevant department and for system confirmation of receipt and preparation of a response.
Personal data (email address, type of assistance, message subject, message content, consent for data processing, question receipt time, and response sending time) are processed based on the individual's valid consent (Article 6(1a) GDPR).
Your personal data is stored by the Employment Service for a maximum of 1 year after the response has been provided or until you revoke it on our server.
To revoke consent, request deletion, or modification of data, please contact us at the email address: dpo@ess.gov.si.
E. Introduce yourself to Slovenian employers
We will record your name and surname, e-mail address, phone number, citizenship, current country of residence, desired job position, work experience, your CV, the content of the message, the time the message was sent and received.
We collect data in order to share it with employers in the Republic of Slovenia who are looking for employees and for assistance of the Employment Service of Slovenia in this regard.
Your personal data is stored by the Employment Service for a maximum of one (1) year after the receipt of your message or until you revoke it on our server.
To revoke consent, request erasure or modification of data, please contact us at the email address: dpo@ess.gov.si.
Personal data (name and surname, e-mail address, phone number, citizenship, current country of residence, desired job position, work experience, your CV, the content of the message, the time the message was sent and received) are processed based on the individual's valid consent (Article 6(1a) GDPR).
5. Use of eServices
5.1 Registration for using eServices
Use of the publicly accessible services of the ESS information system (web applications, portals, etc.) on the ESS website (hereinafter: eServices [in Slovenian: eStoritve]) is possible by using a user name and password or a qualified digital certificate. The use of eServices is possible with qualified digital certificates issued in Slovenia or in another EU Member State.
The user’s email address is used as the user name. Upon successful registration the ESS information system sends the user an activation message to their email for the purpose of confirming their email address. Following confirmation of the email address, a password is assigned automatically and sent to the email address. After successful login to the eServices the user can change their password at any time.
Users who wish to use the eServices on behalf of and for the account of a business entity can register for eServices by means of a qualified certificate issued to them as the authorised officer of the entity by the checker.
The use of private qualified certificates for business purposes is not possible.
In cases referred to in the preceding paragraph the ESS will notify the users regarding the registration via email.
Users who wish to use the eServices on behalf of and for the account of a business entity can also register for eServices without a qualified certificate, by completing an online application for eServices.
In cases referred to in the preceding paragraph the ESS will send by ordinary mail a written notification of completed registration to the registered office of the business entity.
Users who wish to use eServices in their own name and for their own account may register for eServices with or without a qualified certificate. In either case the ESS sends the user a notification of registration by email.
5.2 Authorisation to use eServices in the case of business entities (on the portal for employers)
The first user that performs the registration for an individual business entity acquires the role of custodian, who may authorise other users to use the eServices so that they may use the service on behalf of and for the account of the business entity.
The custodian designates an authorised person using a pair of data that comprise the user name and tax ID number of the business entity for which the authorised person works, or a pair comprising the tax ID number of the business entity and tax ID number of the authorised person who has been issued a qualified digital certificate.
The custodian may delegate custodial authority to another authorised user.
When an authorised user logs in to eServices for the first time after obtaining authorisation, they can make use of the list of all assigned new authorisations for various accounts. For each assigned authorisation the user decides whether to accept it or not.
The authorisation enters into force only when the authorised user accepts it. From that moment until cancellation of the authorisation the ESS will enable the authorised user to use the eServices on behalf of and for the account of the holder of the electronic account.
5.3 Protection of the confidentiality of means and procedures of identification
The data controller shall protect data on users and all other data in accordance with the requirements of the General Data Protection Regulation and the valid legislation governing personal data protection.
The user must protect the confidentiality of means of identification and authentication procedures, and use them in accordance with these General Terms and Conditions.
In the event of negligent conduct or abuse of an eServices user account that has harmful consequences for the ESS or other eServices users, the user may be held materially or criminally liable.
5.4 Costs of using an account
Registration and the use of electronic signature services in the ESS eServices are free of charge for users.
6. Responsibility of the ESS regarding eServices
The ESS makes every effort to ensure that eServices are available 24 hours a day, 7 days a week, but does not guarantee that the service will function without interruptions, problems, faults or errors, nor does it guarantee the success of using eServices.
For technological, legal or business reasons the ESS may modify specific parameters of the service or may withdraw the service.
Any liability of the ESS or its staff is excluded to the extent permitted by law.
In no case shall the ESS or its staff be held liable for any loss of or compromised access to data or any other coincidental, indirect, particular or consequent loss events originating from the use of or impossibility of using eServices, including and without restriction regarding lost income or anticipated profit, loss of good name, loss of business, loss of data, technical faults or erroneous functioning or other damage events.
Equally the ESS accepts no liability for any delay incurred by persons submitting applications or reports within the prescribed deadlines due to the non-functioning of eServices.
The ESS may at its own discretion cancel or temporarily prevent access to and use of eServices due to an infringement of these General Terms and Conditions, valid regulations or any other conduct which the ESS believes to be unlawful or harmful to third parties or to the operation of eServices.
In the event of cancellation the user will not be able to use eServices, and the ESS will use all necessary means or steps to implement the cancellation and all legal means against such user.
On the eServices website certain links lead to other websites not administered by the ESS, which does not check their content. The ESS offers these links as a working tool for users and such links do not represent any approval by the ESS of products, services or information, and they do not constitute any link between the ESS and the administrators of the linked websites.
In the event of force majeure the ESS does not accept any liability for non-fulfilment of any of its obligations or for damage caused for reasons beyond its control. Force majeure shall be taken to mean any unforeseen and unexpected events which the website administrators could not foresee or prevent, and which impact the operation of the website and its services.
7. Responsibility of the eServices user
Users are bound to use eServices in accordance with the regulations and these General Terms and Conditions. Users may use eServices on their own behalf and for their own account and on behalf of and for the account of those business entities for which in accordance with the valid regulations they hold authorisation or some other legal basis for such business link, representation or agency.
Users expressly agree to use eServices or any other digital content linked to eServices exclusively at their own responsibility. The content and functionality of eServices are enabled for users on an “as is” basis and without any guarantees.
In using eServices users expressly undertake not to act unlawfully or to endanger the information security of eServices (e.g. false representation, downloading illegal content, infringement of intellectual property rights, unauthorised gathering of personal data or trade secrets, transferring malware, unauthorised modification of content, disrupting communication in any direction or unnecessarily burdening eServices, attempts at false representation and so forth) or encourage third parties to engage in such conduct.
Users agree that any kind of data or documents sent through the use of eServices will be considered complete and accurate.
Users undertake to be especially vigilant in protecting their personal password and data for a qualified digital certificate, and not to provide them for use or viewing by third parties, and they shall be held fully liable for any damage caused indirectly or directly because unauthorised third parties have used their access to eServices.
Users also undertake in adhering to the user instructions from the manufacturers of hardware and software, instructions and warnings of the ESS, the checker that issued a qualified certificate, and other professional rules, cautions, instructions and recommendations, to ensure the highest possible level of security measures and reduction of the risk of unauthorised access or compromising of data or operation of eServices, and to notify the ESS immediately of any potential security incidents related to the use of eServices.
Users of eServices may at their own discretion, and in accordance with the user instructions, cancel their use of eServices and thereby their contractual relationship with the ESS stemming from assent to these General Terms and Conditions, and may request the deletion of their user name and other data stored for the requirements of access to such data. The contractual relationship shall be deemed terminated and the ESS shall delete the user name and delete or anonymise other data in the eServices system, if the user requests deletion or has not used the PoisciDelo.si portal for more than 18 months.
In order to prevent the abuse of their user account, users must handle with particular care the data for accessing their account, so as not to disclose them to others and to prevent possible abuse of such data or the eServices user account.
Users must report any suspicion of abuse of their data for accessing their eServices user account immediately to the administrator by email at dpo@ess.gov.si, and must also accept liability for any damage caused by disclosure or negligent use of their access data.
After logging in, users of the PoisciDelo.si portal can use the function Delete account (Izbris računa) in the column My account (Moj račun) to fully delete their user account at any time. The user will be notified of the deletion via their registered email address. Users of other eServices facilities may send a request for deletion of their account to the email eStoritve@ess.gov.si, wherein they must state the following information: name and surname, name of portal and email address of the user account.
In the event of abuse of a user account or eServices the administrator may revoke the user’s right to use the account with immediate effect.
The administration accepts no material or other liability for any damage or other consequences arising from a user’s abuse or deletion of a user account from eServices.
8. Cookies
8.1 What are cookies?
Cookies are small text files that are stored on your computer or mobile device by the websites you visit. They have different functions. Cookies help the website remember your settings, e.g. language, font size, and other settings that you have specified on your computer to view our website so that you do not have to set them again each time you visit the site.
In this way, websites can remember your preferences, information that you have already voted on the site's poll, or just the fact that you have already logged in to the site.
Some cookies are necessary for the site's functionality (for example, a cookie on logging in, a cookie on your shopping cart), some are intended to improve user experience (such as saving user preferences), and some are also used to monitor the site visits, which helps its controller to continuously improve the website and the user's experience with it. Some cookies also allow tracking of users across multiple websites.
8.2 Managing cookies
Most web browsers automatically accept cookies.
8.3 What cookies do we use?
Most of the ESS's websites use cookies to provide a better user experience and monitor visit statistics. They are a convenient tool for keeping content fresh and relevant, in line with the interests and preferences of website users.
By using cookies, the ESS evaluates the effectiveness of website design, as well as the relevance of content and ads offered to the user on the ESS's websites. A cookie is stored for a maximum of 1 year. The user has the option to agree or disagree with the use of cookies.
Cookies can be set by the ESS's website you are visiting or by other trusted websites/services that display the content on the page you are viewing (e.g. YouTube, Google Analytics, Facebook).
The portal PoiščiDelo.si and the portal for employers use only Google Analytics cookies for statistical purposes, but only on the Vacancies service (only cookies that are necessary for the technical operation of the website – maintaining a user's session).
8.4. What data are collected regarding the behaviour of users and their devices?
Anonymised IP data are monitored. The data are available for a maximum of 365 days. The data are collected at the Amazon Web Services infrastructure in Ireland (EU).
9. Statement on personal data protection
The ESS will contact you in the following cases:
- if you subscribe to eNotifications (eObvestila),
- if you submit a question or request for information to the ESS for the purpose of establishing contact,
- if you communicate your contact details on the basis of personal consent as part of using eServices (e.g. the portal PoiščiDelo.si, Portal for employers) for the purpose of establishing contact,
- if you submit electronic applications and contracts for exercising rights under the Act regulating the labour market,
- for the purpose of user identification.
At your request, in accordance with the regulations in the field of protection of personal data relating to you, the ESS shall enable you to view your personal data, copy them and print them out and shall also provide you with a list of users to whom personal data have been transferred, when, on what basis and for what purpose.
At your request, in accordance with the regulations in the field of personal data protection, the ESS shall also provide you with other information regarding your personal data that it collects.

The ESS will transfer your personal data to third parties (e.g. employers on the portal PoiščiDelo.si, service Profile) only if you consent to data being transferred to third parties.
Only the data on the jobseeker profile for which the jobseeker has given their consent to be transferred to the EURES portal may be transferred from the portal PoiščiDelo.si to EURES portal, and the data will be used in the search engine and the application for matching the offers and demand on the EURES portal and can be displayed as a result of successful matching and search.
An individual can choose on the portal PoiščiDelo.si that all or only selected personal data remain hidden and not shown to users of the EURES portal, so that certain data of the jobseeker profile will never be used for search and matching purposes, even if they were transferred to the EURES portal (e.g. data on citizenship, disability, date of birth, age, sex, names and contacts of previous or current employers).
The data transferred to the EURES portal are stored in the database, which is in the data centre of the European Commission.
Employers registered on the EURES portal can view the jobseekers profile data for which an individual (jobseeker) has agreed to be processed for the purposes of job search and matching with employers based on job vacancies within the EURES network.
The security of personal data shall be carried out in accordance with the provisions of the ESS's internal acts that determine the security policy of the ESS.
If it is likely that a personal data breach could threaten the individuals' rights and freedoms, the ESS shall immediately or no later than within 72 hours after it finds out about the breach officially inform the competent supervisory authority (Information Commissioner) about the breach, in accordance with the GDPR.
The official notification on the personal data breach referred to in the preceding paragraph shall be submitted by the ESS on the form on the notification about the breach, which is published on the Information Commissioner's website.
When a personal data breach is likely to result in a high risk to the individuals' rights and freedoms, the ESS will also inform the individuals, except in exceptional cases provided by the GDPR.
When a personal data breach is likely to result in a high risk to the individuals' rights and freedoms, in accordance with the provision of the General Data Protection Regulation, the ESS must also communicate to the data subjects without any undue delay that there has been a personal data breach.
The Employment Service of Slovenia (ESS) conducts video surveillance to safeguard individuals and property, maintain order on its premises, and regulate access to and leaving its offices and car parks.
The implementation of video surveillance is subject to conditions laid down by law and is conducted at the following locations:
- ESS Central Office in Rožna dolina, Cesta IX/6, 1000 Ljubljana – main entrance to business premises, side entrance/access to the courtyard through iron gates, rear side entrance from the courtyard/parking lot to the business premises, left side of the front parking lot, right side of the front parking lot, side entrance/parking lot behind the boom gate, fire exit on the front side of the building.
- The Ljubljana Regional Office at Parmova cesta 32, Ljubljana – the main entrance with revolving doors to the office premises, the main side entrance and bicycle parking on the left side, the right side of the main entrance and the ramp for people with disabilities, the rear entrance, and the right side of the parking lot, and at Smoletova 12, Ljubljana – an entrance to the premises.
Legal basis: Article 1/6 (e) of the General Data Protection Regulation in conjunction with Articles 76 and 77 of the Personal Data Protection act (ZVOP-2).
User categories: Employees of the security provider responsible for securing the premises of the Employment Service of Slovenia have access to a screen image (without sound) captured by a camera for monitoring purposes. They may watch live footage to maintain security on the premises. Only authorised personnel are allowed to review the recordings in the video surveillance records.
Information on the transfer of personal data to third countries or international organisations: Data is not exported to third countries.

The ESS undertakes to protect the confidentiality of the personal data of website users and to use a secure connection on websites and portals. The ESS will use the collected data exclusively for the purposes for which they are provided by the website users and within the legal competence of the ESS.
Personal data and contact information will not be used for other purposes and will not be disclosed to third parties without the explicit permission of an individual – the website user, unless otherwise provided by the law. The ESS will do everything to protect your personal data from any violations and abuses.
The controller may occasionally amend the General Terms and Conditions due to changes in the content and method of operation of eServices where required by:
- new or amended regulations,
- modifications of technical specifications or
- identified needs for improvement of services or method of operation of the ESS eServices system.
If an update impacts the rights and obligations of ESS eServices users, the controller will first notify users 15 days prior to the start date of validity of the update, by sending an email to the email address linked to the eServices user account.
If the individual user does not agree with the communicated updates, they may delete their user account. By using the services or accessing user account services following implementation of an update, the user indicates their agreement to the new General Terms and Conditions and the modified contractual relationship with the controller, tied to the use of the eServices user account.
If an update only affects the functionality of services, users will be notified through the publication of a notice on the ESS website: www.ess.gov.si, by email in the eServices user account or in eServices.
