Fulfilment of conditions and granting of consent

1. Consent for cross-border services provided by posted workers

Foreign employers can be granted this consent for workers that you employcontinuously for at least 9 months.

We issue the consent at the request of the administrative unit for cross-border services that you provide on your own behalf and for your own account on the basis of a contract concluded with a client ordering services from an EU Member State, Norway, Iceland, Liechtenstein or Switzerland (or on the basis of a contract with a service provider that has a contract concluded with a client ordering services from at least one of those countries).

Consent for a posted worker in the context of cross-border services may be granted more than once, whereby the overall duration of the provision of service should not exceed 90 days in a calendar year.
 

2. Consent for movement within affiliated companies

You can obtain this consent for an employee having at least higher education who is transferred for the purpose of career development or training in business techniques or methods, provided that they have been employed by you for a continuous period of at least 6 months.

We grant consent for the movement of workers within affiliated companies at the request of the administrative unit.
 

3. Consent for training of posted workers in associated companies

Prior employment is not required as a condition for granting the consent.

We grant consent for the training of posted and Slovenian workers in associated companies at the request of the administrative unit.

 

What supporting documents to attach?

Please attach the following evidence of compliance with the conditions for granting the consent to your application for a single permit:

  • a photograph or a reference number of a foreign national from an electronic photo repository,
     
  • a passport or a certified photocopy of the passport of a foreign national,
     
  • proof of social insurance in the country from which the worker is posted,
     
  • proof of sufficient means of subsistence,
     
  • a certificate from the criminal record of the home country of a foreign national (always when the first single permit is issued, otherwise only on request),
     
  • proof of registration of a foreign employer.
     

1. Cross-border services provided by posted workers

Please attach the following supporting documents to your application for a single permit:

  • a contract on the provision of services for the client,
     
  • proof that the posted workers have been employed for at least 9 months by the foreign employer (or in its affiliated company based in a third country) posting the workers to Slovenia.
     

2. Movement within affiliated companies

Please attach the following supporting documents to your application for a single permit:

  • the document appointing or posting workers to the temporary work position showing what duties they will perform,
     
  • proof that the posted workers have been employed for at least 9 months or 6 months by the foreign employer (or in its affiliated company based in a third country) posting the workers to Slovenia.
     

3. Training in associated companies

Please attach the following supporting documents to your application for a single permit:

  • the document appointing or posting workers to the temporary work position showing what duties they will perform,
     
  • a training contract between a company in Slovenia and a company based in a third country,
     
  • proof of association through capital ties or a business-technical cooperation or technology transfer agreement,
     
  • training programme for posted workers,
     
  • consent of a competent chamber or employers’ association.

Procedure for obtaining a single permit

Form 11/1 (movement)

1. Fill in the single permit form and attach all the necessary supporting documents.

These include evidence of compliance with the conditions for consent to the single permit.

2. You can apply for the single permit at the administrative unit.

3. In the single permit procedure we grant consent to this permit (ex officio at the request of the administrative unit).
